These Android and iOS apps, hotelwaze.com, and all services and products that we offer shall be governed by these Terms and Conditions and shall apply to any and all pages, subpages, and links attributed to it. As such, these Terms and Conditions are subject to change and may be altered, amended, or otherwise modified without prior approval or notice to any third person or user thereof. By accessing, browsing, or using this (mobile) website, and/or by placing or completing a reservation, you acknowledge and unequivocally accede to have read, understood, and agreed to the totality of these

Hotelwaze owns and operates the entire content and infrastructure of this (mobile) website and is intended and provided for your personal and non-commercial use.

Scope of Service

Our business includes providing an online platform for bridging and connecting customers and tourism establishments such as, but not limited to, hotels, motels, theme parks, travel agencies, theaters, concerts, and any other travel and tourism-related products and services (“service providers” for brevity), by advertising and offering reservation and online booking services. You are entering into a legally binding contract with our service providers for any and all reservations and bookings made through this (mobile) website. Hotelwaze.com acts exclusively as an intermediary between the customer and the service provider by sending and transmitting information to facilitate transactions.

Hotelwaze does not own or produce the information provided by the service providers and are exclusively and solely under the latter’s effective control and discretion. The service providers are responsible for any alteration, modification, amendment, or revision of any information regarding their respective establishments, including but not limited to, rates, availability, location, quality, and all other information. We take pride in providing you with the best quality service, as such we treat with utmost diligence and care to ascertain the veracity, accuracy, and correctness of all information coursed through our (mobile) website. However, Hotelwaze shall not be liable for any misinformation, wrong information, or misleading information for any content displayed through Hotelwaze.com, whether through typographical errors or otherwise.

Unless expressly approved or allowed in a private document, Hotelwaze reserves its right and therefore prohibits any and all persons, juridical or otherwise, from reselling, embedding, mirroring, copying, using, displaying, reproducing, or any form of appropriating information and content available within this (mobile) website for any commercial purpose, whether or not in direct competition with the business of Hotelwaze.

Privacy

Hotelwaze.com adheres to internet and information privacy. Hence, all dealings, reservations, transactions and information coursed through our (mobile) website shall be considered confidential information and shall be subject to existing laws, rules and regulations of the United States of America, relative to confidentiality and privacy.

For Hotel Service Charge

You are our business. As such, we do not charge customers and users of Hotelwaze.com any additional and hidden fees or charges for hotel reservations, hotel bookings and hotel transactions done through our (mobile) website. All rates and prices appearing on our (mobile) website, posted by our service providers, are exclusively and solely controlled and modified by the latter.

Service Provider’s Terms and Conditions

Hotelwaze reserves its right and is not liable to any and all repercussions and effects of any hotel prepayment, hotel cancellation, hotel no show, or any incident of the same character. As a binding agreement/contract, you agree to accept all penalties, surcharges, and effects of the above incidents and any conflict thereto must be coursed through the specific service provider.

The Terms and Conditions, house rules, and policies of the service provider shall be applicable in the absence of any provision hereto. Hotel refunds, hotel cancellations, hotel rebooking, hotel amendments, hotel payment options, hotel late arrivals, hotel no-shows, and other similar incidents shall be exclusively governed by the service provider, even though this (mobile) website may have options for the same. The customer bears responsibility in following all of the above-mentioned policies of the service provider and shall declare Hotelwaze free and harmless from any and all liability borne out of any transaction or incident with our service providers.

Correspondence and Communication

By using our services and (mobile) website, you agree and accept to receive an email about the relevant information included in your booking or reservation. Hotelwaze disclaims any liability or responsibility for any communication with the hotel service providers on or through its (mobile) website. You cannot derive any rights from any request to, or communication with the hotel service provider or acknowledgment of receipt of any communication or request. Any delay in the communication with the hotel service provider coursed through our (mobile) website cannot be guaranteed and shall not incur any liability to any of the effects thereto.

Any claim or complaint against Hotelwaze or in respect to any of our products and services must be promptly submitted and communicated within 15 days after the scheduled day of consummation of the product or service. Any claim or complaint submitted after the 15-day period may be rejected, and the claimant shall forfeit their right to any damage or compensation.

Disclaimer

Hotelwaze shall not be liable for any damages, consequential or otherwise, to any person or entity to any service or product attributable to our (mobile) website, and in cases of the contrary, shall only be liable up to the extent of the aggregate cost of the reservation as reflected in the confirmation email sent to the customer.

The officers, directors, employees, representatives, relatives, service providers, partners, agents, or others involved in creating, producing, promoting, or otherwise making available the (mobile) website and its contents shall not be liable for:

(i) any punitive, special, indirect, or consequential loss or damages, loss of contract loss of profit, loss of claim, loss of revenue, any loss of production, loss of or damage to goodwill or reputation;

(ii) any inaccuracy (typographical or otherwise) relating to the information supplied by our service providers on our (mobile) website;

(iii) any direct, indirect, consequential, or punitive damages, incurred or paid by you, pursuant to or arising out of, or in connection with the use, unavailability, or delay of our (mobile) website, or

(iv) any injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred, or paid by you, whether due to acts, errors, breaches, gross negligence, willful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the service provider, including any of their employees, directors, officers, agents, representatives, whose products or service are (directly or indirectly) made available, offered or promoted on or through the (mobile) website, including any (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.

The customer acknowledges and knows that the service providers are the ones liable and responsible for the payment, collection, remittance or withholding of any and all government taxes, fees, and charges due to bookings, reservations, or sales made or coursed through Hotelwaze.com. Hotelwaze denies any and all liability arising out of, or in connection with, the remittance of the said government charges to relevant taxing authorities and agencies.

The customer certifies and warrants that all files images, pictures, works, and articles submitted and uploaded unto the system or within the (mobile) website are owned by him/her and that no copyright infringement or any violation of intellectual property laws and other related laws, such as but not limited to anti-pornographic laws, are being violated. By uploading such files, pictures, images, works, and articles, the customer/user unequivocally allows and permits Hotelwaze and Hotelwaze.com to use the same for any purpose as it deems necessary as permitted by law. Any and all liability in relation to the uploading of the said images, pictures,images, works and articles shall be borne exclusively by the customer/uploader. The customer/uploader further warrants and certifies that all files, pictures, images, works and articles are free from viruses, malware, spyware, or any malicious software and codes, and accepts responsibility and liability in connection to any damage suffered by Hotelwaze in relation to any loss of data, information or content, or any and all incidents related thereto. Hotelwaze reserves its right to delete all of the above pertinent uploaded data as it deems necessary that violated any of the terms and conditions set forth herein to protect its business and interests.

Intellectual Property Rights

All information, content, data, code, software, or material as shown in Hotelwaze.com are the intellectual property of Hotelwaze and its service providers as the case may be unless otherwise provided thereto. Subject to international intellectual property laws, Hotelwaze shall retain exclusive ownership, rights, title, and interest over Hotelwaze.com and any and all of its contents and it shall be prohibited for any person, juridical or otherwise, to use, copy, paste, scrape, embed, mirror, publish, market, integrate or made commercially available, without the prior express consent and permission from Hotelwaze.

Miscellaneous

Any interpretation, construction, and any disputes arising out of the provisions of these Terms and Conditions shall be governed by the laws of the State of California, United States of America, and suppletorily, the Federal Law of the United States of America. Consequently, any action relevant thereto shall be brought within the competent courts of the State of California, United States of America.

The provisions of these Terms and Conditions shall be understood as separate and distinct from each other and shall remain valid and binding in cases where some of the provisions thereof might become invalid, obsolete, unenforceable, or non-binding according to the laws of the State of California, United States of America.

Hotelwaze Car Booking Terms of Use

Important Information

You consent to these General Terms of Use as well as the terms of our Privacy Policy by using our app. Hotelwaze should be contacted if you have any questions about these terms or a car rental.

When you make a car reservation via our app, you consent to and accept all of the terms and conditions on it, including the Terms & Price information, so make sure you read and understand everything.

We reserve the right to change these terms at any time.

The information above constitutes a request to Hotelwaze to locate a car rental offer from one of our many rental partners.

Any contract you enter into at the local destination is solely between you and the rental partner; Hotelwaze is not a party to this contract in any way.

Our rental partner will send the car to you directly, and we will serve as your agent.

Your signature on any rental contract agreement is irrefutable evidence of your approval of the rental partner’s services and conditions, as well as the laws of the country in which the rental will take place.

Liability

In the event that any issues with the terms of your contract occur, Hotelwaze takes no responsibility for the rental partner's failure to supply the rental car. We will not have any reimbursement or refund for any costs incurred as a result of a change in your arrangements.

The preceding is legally binding and extends to all contracts involving the provision of our services, except any other guarantees or conditions. Hotelwaze's actions would not imply compliance with any other terms or conditions.

Our responsibility to you, if any, in the event of a dispute between you and Hotelwaze is limited to the original sum paid to us.

Indirect loss

Hotelwaze is not responsible for any indirect losses that arise as a result of the primary loss or harm and are not foreseeable by you, the renter, or Hotelwaze. We are therefore not responsible for any lost income, lost opportunities, consequential losses, loss of reputation, penalties, or charges incurred as a result of the issue.

Irresistible Force

Due to any unforeseen or destructive situation fairly beyond our control, hindered or prevented as a consequence of force majeure, Hotelwaze cannot be held liable for the failure to deliver the obligations expected under or pursuant to this booking for any purpose. The booking and all insurances become void in the event of Force Majeure.

We will do our utmost to redirect your verified booking to another rental partner if the local provider is unable to fulfill its obligations in supplying the vehicle due to insolvency. This might not be possible during peak hours. In the event that we do not have an alternative supplier, you will be informed, the booking will be cancelled, and the advance payment and all other payments will be forfeited.

Hotelwaze does not guarantee the accuracy or validity of any travel details or links on its website. You use such tools at your own risk.

Our app is usually accessible 24 hours a day. Due to system maintenance, upgrading, or circumstances outside Hotelwaze's control, the software may be temporarily inaccessible on rare occasions. The customer service line can be contacted for assistance.

Booking rates for a rental car are calculated based on the information you provide, so their accuracy is entirely dependent on your input.

Hotelwaze reserves the right to change the contents of its app at any time and without warning.

Hotelwaze accepts no obligation or liability if the rental provider's terms and conditions as shown on the app vary from those in effect at the time of pick-up. Or for the failure of the rental to take place due to the lack of or incorrect presentation of paperwork (voucher, credit card, driver's license, etc.) on the spot.

Hotelwaze is not responsible for any additional costs incurred as a result of paperwork being signed for and approved locally.

Booking Conditions

The customer will not be charged a booking fee.

During the booking process, there are no credit card fees (except for PayPal payments).

All Credit cards are all accepted on our app for bookings.

As the acting agent, we do all we can to ensure that the order is confirmed at the lowest possible price and as soon as possible.

Since we use an online system, confirmation is usually obtained within a few minutes of the booking being made (12 hours maximum, rarely more).

Declined Booking

If our first rental partner is unable to validate your reservation due to unavailability, we will make every effort to submit your reservation to another rental partner for confirmation.

Booking Option

The rental fee is charged in full at the time of reservation.

Any booking that cannot be checked is canceled, along with any payments that have been made.

Any app purchases will be handled in the local currency of the rental partner.

Any additional equipment or facilities purchased locally will also be paid in the local currency of the car rental partner.

Any remaining rental balance is charged in local currency at the destination.

Cancellation Policy

The Renter's First Cancellation made online via the app within 5 minutes of the rental start is free of charge. Cancellations made after 5 minutes will be charged a non-refundable maximum fee of 5% of the 1-day booking amount in Philippine currency.

Hotelwaze will charge a non-refundable limit of 5% Philippine currency for every consecutive Renter's second Cancellation online via Car Booking after the rental launch. On a third cancellation online via the app after the rental begins, Hotelwaze will charge the renter a non-refundable full sum equal to one day's worth of the car booked in Philippine currency.

*Your currency sum could be slightly higher or lower depending on the currency exchange rate used by your bank.

You won't get a refund if you don't turn up or don't have the proper documentation (Voucher, Hotelwaze app with pairing code, 2 valid government-issued I.D driving licenses, etc.)

Over a 24-hour cycle, the number of cancellations is counted. For instance, suppose you booked a rental car for April 21 at 8 a.m. and then canceled it. That'll be the first time you've had to cancel. If you book again on April 22nd at 8 a.m., you will be refunded. The cancellation period has been reset, and your first cancellation will still be counted.

Amendments and Changes

Changes to a Confirmed Booking

Done via the app.

A new order is created when a change is made.

The original order remains valid until the rental partner confirms a new order (change).

The original order is immediately canceled after confirmation, and all associated payments are changed.

Please keep in mind that any changes to your reservation are completely free of charge.

When you change a not-yet-confirmed booking, the initial order is automatically canceled.

An extension of a rental booking may be done either by making a new reservation via the app (which needs confirmation from a rental partner, which is not always the same) or by contacting the local provider.

If the customer wants to return the car earlier than scheduled, Hotelwaze will not issue a refund for the unused days; it is up to the car rental company to determine whether or not to do so.

Optional items and Fees

Locally acquired optional insurances/options are under the jurisdiction of the local rental partner.

And when reservations are made, options are subject to availability. There is no fee made locally for goods that are not accessible.

Any changes to your rental made locally, such as a change in pick-up/drop-off time, date, or location that differs from what is specified on your booking details in the app, can result in additional charges.

Child seats

Most countries need it, and it must be ordered at the time of booking.

Notice that the standards for baby/child seats in other countries can vary.

It is recommended that you bring your own.

You would be allowed to install the seat in the car due to insurance regulations.

Roof racks, Wi-Fi systems, and a GPS navigation system are all available options. Are available in certain places, but must be requested when making a reservation.

Some vehicles do not have the above features.

Even when booked in advance, all of the above-mentioned equipment is subject to availability in certain places. If the service is not accessible locally, there will be no fee.

Additional drivers

In most cases, an extra driver is allowed at no cost.

Must be requested at the time of booking (even if it is free).

Additional drivers will be charged a young driver fee (if applicable), which will be paid locally.

Ferrying the rental car

Domestic travel is usually permitted, but it must be demanded at the destination. Any additional costs will be charged on the spot. You must notify the rental partner that you will be driving the vehicle on a ferry.

Driving License & Age Limits

Both destinations require a valid driver's license in all situations. In some countries, in addition to the national license, an international driving license is required.

Delivery & Collection Charges

If applicable, any ‘out of operating hour' charges are ALWAYS INCLUDED in our rates.

Any deviation from the recorded pick-up/return times on your car rental could result in additional fees, a closed station, or your reservation being marked as a No Show.

If you want to add an extra day or time to our app, you must modify the return time adjustment.

Hotel Deliveries and return

Can normally be made to Hotels located ‘within the city limits- meaning hotels situated within the center of the city radius.

Hotel details must be given at the time of booking.

All Hotel deliveries are on a request basis and are only accepted if confirmation is received.

Upon car return, you are required to notify the hotel for car pickup.

Note: Deliveries to accessible private addresses are also an option.

Other items and services

Our rates cover all taxes, airport surcharges, and fees.

During the booking process, our app displays information about the Inclusions/Exclusions or Mandatory items that apply to your rental. Nothing is concealed and everything is visible!

Insurance Packages offered:

As seen on the car selection screen, each of our car groups has a corresponding cover kit.

Provision of a car

Bookings are verified based on vehicle types, rather than specific models.

The app's named cars are only intended to serve as representative examples of a vehicle category's size, specifications, and performance.

The rental partner will have a vehicle that meets the requirements of the booked car category.

If the booked vehicle category is not eligible, the rental partner reserves the right to upgrade the selected vehicle category on site to a higher one.

Excess Coverage by Hotelwaze

Only the excess amount of the car category confirmed on the car rental voucher will be protected.

Breakdown/ Accident

In the case of a failure, injury, or another emergency, you must immediately contact the rental partner for instructions and assistance. It is strongly advised to contact the police even if the harm is minor. When an insurance claim is filed, all relevant paperwork must be held.

Blacklist

When anyone is found to be engaged in fraudulent transactions or behaving dishonestly, Hotelwaze has the right to blacklist them from the app.

In cases of insurance fraud or some other attempt at deception in order to obtain funds unlawfully, Hotelwaze would not hesitate to take legal action.

Booking Information

When you make a reservation with Hotelwaze, you must include personal information such as your name, surname, phone number, credit card information, e-mail address, and driver's age. Since Hotelwaze functions as a booking agent, we must provide our rental partners with critical booking details.. This data will be sent to the country where your reservation will be made. By submitting your reservation, you agree to this data transfer for the purposes mentioned above. Our Privacy Policy explains how we safeguard your sensitive information.

Using Telephone Calls

Hotelwaze may record telephone conversations from time to time for the purposes of training and quality assurance for our customer service representatives.

Subscriptions and Research

Hotelwaze uses email to deliver new promotions, seasonal special offers, and other news tips on occasion. You can unsubscribe from this service at any time by clicking the unsubscribe link in the email. Non-personal information (for example, visited location, age, etc.) can be used by Hotelwaze solely for internal purposes to help us assess our customer service, marketing research, and app-related information. Hotelwaze takes all available security measures to safeguard your privacy and personal information.

Third-Party Disclosure

Hotelwaze never gives out personal information about its customers to third parties without their permission, unless it is required by law or in an emergency. No personally identifiable details will be sold or rented by Hotelwaze. We may provide third parties with data about our customers, sales and booking trends, and other related details, but this information will not include personally-identifying information.

Evaluations

After the rental period has ended, we give evaluation forms to our customers in order to better serve and improve our services.

Customers are asked to score and rate the local car rental company using an assessment form. This allows us to see how each of our stations is doing at any given time.

Through evaluating our places, Hotelwaze and our providers would be able to use these learnings to improve our services to the highest possible level.

Any customer feedback and experiences shared on the app assist other users in making well-informed decisions.

Personal Data Control

To protect the transfer and storage of your private personal data, we use the most up-to-date online secur technology.

You have the right to check the personal data that we have on file for you by logging into the app.

Credit card information is not processed and is only used during safe bank transactions for the reasons mentioned above. However, if you have a problem with your credit card as a result of submitting your card information online, please contact us.

Hotelwaze and its affiliated parties (owners, directors, managers, staff, and so on) are not liable for any issues, penalties, or injuries that may arise as a result of using the website, app, or any of its contents.

You consent to the terms of our Privacy Policy regarding the collection, storage, and use of your personal data by using the Hotelwaze app. If we make any changes to our Privacy Policy, we will post them on the app and update you via email so you are always aware of what information we gather, how we use it, and under what circumstances we will disclose it.

In addition to the General Terms and Conditions, the Privacy Policy applies.

Disclaimer

As a guest, you accept the app, and any related service or product accessed or acquired through/ through it "as is."

Hotelwaze takes no responsibility for any problems, damages, or losses that may arise as a result of using the app or any of its contents.

Hotelwaze makes no warranties or statements that (a) it's the app or any of its related elements are free of errors or omissions, or (b) the website/server is free of viruses or other harmful components.

Complaints Procedure

Our app is designed to avoid problems, but we recognize that problems do occur from time to time.

If you have any questions during the rental period, please contact the rental partner directly. (Their phone number will be in your e-voucher.)

Complaints about completed rentals are only handled via email. [email protected] must receive all relevant documents.

We try to resolve grievances within 40 days, but it can take a little longer depending on the nature of the complaint.

Only complaints received by Hotelwaze within 40 days of the rental e-vouchers' final day of rental will be considered.

Hotelwaze is only subject to the laws that apply to the Philippines' local courts. Hotelwaze will abide by all laws and regulations enacted by the authorities.

Actions against our car rental partners are limited to the applicable laws and the jurisdiction of the car rental provider's country courts.

Copyright

It is prohibited to use the Hotelwaze app for any reason other than booking a car rental for personal use.

You must not use our app or search engine for any illicit transactions or acts. It is forbidden to download or attempt to retrieve any information from our app, as well as to harm or interfere with its normal operation.

We track the operation and use of our app on a regular basis, and any suspicious activity on our app will result in access being denied.

By using our app on your own, you are agreeing to these Terms of Service.
